Development Ministry Clarifies Councilor Role Amid Legal Confusion
The Ministry of Development has clarified the application of new incompatibility laws affecting local councilors. Cseke Attila stated councilors are not automatically forced to choose between their mandates and jobs. Law 165/2026 amended the Administrative Code, causing confusion. Alin Tișe criticized the legislative process, calling it chaotic. The Ministry emphasized that special laws take precedence over general laws.
The Romanian Ministry of Development has moved to clarify the confusion surrounding recent changes in incompatibility laws affecting local councilors. Cseke Attila, Minister of Development, stated, "Consilierii nu sunt obligați automat să aleagă între mandat și locul de muncă." This comes amidst widespread administrative tension caused by the new legislation.
The confusion arose after Law 165/2026 modified Article 550 of the Administrative Code. Thousands of councilors faced potential incompatibility issues. To address the situation, the Ministry sent a directive to prefectures, clarifying that the new provisions do not automatically apply to local officials.
Cseke further explained, "Nu există incompatibilitate între calitatea de consilier local/județean și angajat contractual din administrație," emphasizing that councilors are subject to Article 88 of Law 161/2003, rather than Article 550 (6) of the Administrative Code, which extends incompatibility to contractual staff.
The Ministry highlighted that the Administrative Code is a general law, while Law 161/2003 is a special law. According to jurisprudence, special laws prevail over general laws, even if they are older. This assertion was made to clarify that roles such as teachers and doctors are governed by their specific professional statutes and not the Administrative Code. The distinction is important for understanding the legal framework. It prevents unnecessary conflicts between councilors' mandates and their professional employment.
Alin Tișe, President of the Cluj County Council, criticized the legislative process leading to these changes. He described it as chaotic. In his words, "Laws made on knees, without sense, voted in underwear from beach." He further expressed his frustration by stating, "Asta nu mai e doar incompetență. E sabotaj administrativ cu acte în regulă."
Previously, 15 councilors in Cluj County were informed they needed to make a choice between their council roles and other employment. This prompted significant unrest. The Ministry's clarification aims to resolve these administrative challenges and restore order.
