The Cluj Court of Appeal has sentenced five police officers, including former chief inspector Mihai Rus, for their involvement in a cover-up of a serious speeding incident. The public cost of this scandal is significant, as it undermines trust in local law enforcement and incurs additional judicial expenses. Mihai Rus, once a police quaestor and chief inspector of Inspectoratul de Poliție Județean Cluj, received a three-year suspended prison sentence with a four-year probation period.

Additionally, Rus faces a two-year ban from holding any public office and must complete 90 days of community service. His conviction rests on charges of complicity in abuse of office and making false statements, according to the Cluj Court of Appeal. Mircea-Aurelian Rotar, former head of the Cluj Traffic Service, received a sentence of two years and eleven months of suspended imprisonment.

Rotar was found guilty of complicity in abuse of office, complicity in false statements, and omission to report. He is also required to perform 80 days of community service. The court's decision highlights a failure in leadership and accountability within the Cluj police force.

Ioan-Raul Pașca, a traffic police agent, was designated as the principal author of the abuse of office. He was sentenced to two years and ten months of suspended imprisonment and ordered to complete 70 days of community service. Similarly, Claudiu-Cătălin Mureșan, another traffic police agent, received a one-year and ten-month suspended sentence along with 60 days of community service for his complicity in the abuse of office.

Ciprian Neag, deputy chief of IPJ Cluj, received a lighter sentence of three months imprisonment, which is delayed for a two-year supervision term. Neag's conviction for omission to report further exemplifies the systemic issues within the police department. The incident that led to these convictions occurred on the night of April 29, 2024, when a car was recorded by radar speeding at 110 km/h in a 50 km/h zone.

Instead of enforcing the law, Cluj police chiefs, including the aforementioned officers, intervened to prevent sanctions against the driver. This action prompted an investigation and trial that lasted nearly two years. The Direcția Națională Anticorupție (DNA) played a important role in the case, administering solid evidence that led to the convictions.

The Cluj Court of Appeal concluded that the indictment's facts were substantive, leading to the ordered convictions for abuse of office, complicity, false statements, and omission to report. In addition to the sentences, the court ordered strict monitoring by the Probation Service and required the defendants to follow reintegration programs. The court also mandated the special confiscation of mobile phones used in the cover-up and ordered the defendants to pay state judicial expenses.

The Inspectoratul General al Poliției Române (IGPR) had filed a civil action, which was partially admitted by the court. Despite the defense arguments, the Cluj Court of Appeal rejected them, reinforcing the severity of the actions taken by the officers. The court's decision is not final and can be appealed within ten days, leaving a window for further legal proceedings.

However, the ruling sends a clear message about the importance of integrity and transparency in law enforcement. This case underscores the ongoing challenges within the Romanian police system, particularly concerning accountability and corruption. The sentences serve as a reminder of the consequences of misconduct and the need for systemic reform to restore public trust.

The next step in this legal saga will be whether the convicted officers choose to appeal the decision, as the deadline for filing an appeal approaches.
